The Dashboard is a unique document depository service which we offer to customers of Apegg. For more details about how the service works, information can be found at http://www.apegg.com/dashboard/login.
The provision of the Dashboard service is and shall remain entirely in the discretion of Apegg and subject to these terms of use. Where a customer of Apegg is provided access to the Dashboard it shall only enjoy access and use on an “as is” basis and shall be entirely responsible for maintaining security of any passwords, documents or information provided to it by or on behalf of Apegg. When a customer is provided with access to the Dashboard service it shall be responsible for it and its employees, agents and subcontractors utilisation of the Dashboard. The customer, its employees, agents and subcontractors to whom the customer allows access shall be considered as “Users” for the purpose of these terms and conditions and each of them hereby agree to be bound by them as a User.
It is important that both Apegg and Users of the Dashboard service follow certain procedures to ensure that all documents uploaded to the Dashboard are uploaded in the correct manner affording due respect for the legal rights of third parties.
The User warrants that:
- it has the rights and necessary consents to upload each document to the Dashboard;
- the uploading of any document to the Dashboard does not infringe or violate any intellectual property rights,
privacy rights, contractual rights or any other right of any third party;
- it will not upload any document which may:
(a.i.1) cause offense; or
(a.i.2) harass another person; or
(a.i.3) contain information that the User knows is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, or defamatory; or
(a.i.4) promote unauthorised copying of another person's copyrighted work; or
(a.i.5) contain sensitive personal data without the necessary consents or authorisations.
The User acknowledges that documents may be removed from the folders for the purposes of reading in the Dashboard, but the User shall return all documents to their original location before leaving the Dashboard and shall not retain or make use of any Apegg generated content or copies of any Apegg generated content without the express permission of Apegg.
The User confirms that it will not mark, alter, modify, vary (including varying the sequence), damage or destroy any documents created by Apegg or any third party contained in the Dashboard without express permission.
The User is solely responsible for the documents it uploads to the Dashboard and for its conduct during interactions with other Users of the Dashboard.
The User will be responsible for keeping confidential any passwords supplied by Apegg which enables the User to access certain parts of the Dashboard. The User shall not share any passwords with third parties without the prior written consent of Apegg. The User shall promptly inform Apegg of any potential breach in security.
The User is solely responsible for the payment of any royalties, fees or other monies which may become due to third parties in relation to documents uploaded to the Dashboard.
Apegg reserves the following rights:
- to take technical and organisational measures against unauthorised or unlawful processing of data and information
uploaded by the User; and
- to delete from the Dashboard any document that in the sole opinion of Apegg breaches its terms of use or privacy
policy.
- To delete, suspend or close accounts where Users do not comply fully with the Dashboard terms of use or when an
account has been inactive for a period of in excess of 3 months (see below).
Apegg assumes no responsibility for any error, omission, interruption, loss, deletion, defect, theft, destruction or unauthorised access to, or alteration of any document uploaded unless as a direct result of a wilful breach on the part of Apegg.
Apegg makes no warranties, express or implied, as to documents uploaded by Users to the Dashboard.
Apegg assumes no responsibility for monitoring the Dashboard for inappropriate documents or conduct by Users.
The User shall not share, distribute, or reproduce in any way any copyrighted material, trademarks or other information belonging to third parties without obtaining the prior written consent of the owner.
Apegg reserves the right to interrupt and/or terminate the User’s use of the Dashboard if Apegg becomes aware of the User’s infringement of a third party’s intellectual property right.
The User provides data in order to register with Apegg to use the Dashboard. Apegg may use this data to provide the User with information about goods and services of Apegg which may be of interest to the User. Apegg will not supply the User’s data to any third parties unless required to do so by law.
Documents and data provided to Apegg will be stored in the European Economic Area ("EEA"). By submitting personal data, the User agrees to the transfer, storing or processing of that data. Apegg will take all steps reasonably necessary to ensure that the data is treated securely and in accordance with Apegg’s privacy policy and its obligations under the Data Protection Act 1998.
Apegg reserves the right to remove documents from the Dashboard if the User’s account has been inactive for a period of 3 months. Before the deletion of documentation, Apegg will usually contact the key account holder to inform him/her that the deletion will take place.
Apegg appreciates that projects can sometimes be deferred for a period of time; if a User requires documents to be held in the Dashboard beyond the 3 months period of inactivity, the User must send such request in writing to Apegg.
